Planning & Zoning Boards

From here you will be able to view information regarding the Planning Board and Zoning Board of Appeals (ZBA)

The Planning Board handles applications for uses and building projects that ARE allowed under the zoning ordinance with review, in addition to other duties. These include:

  • Site Plan Review – Review of projects to ensure consistency with the town comprehensive plan and to address any issues with traffic, noise, hours, parking, access, and environmental concerns, among other issues.
  • Special Use Permit – Review of property usage in areas similar to Site Plan Review
  • Subdivisions – A proposal to split a single parcel into two or more independent parcels.
  • Lot Line Adjustment – A proposal to move the boundary line(s) between adjoining parcels.
  • Discusss and propose changes or anendments to the Town Board of the zoning ordinance.
  • Maintenance of the town comprehensive plan.

The ZBA handles requests for projects that are NOT allowed under the zoning ordinance. These include:

  • Area Variance – Pertains to proposed structures that either are not allowed in a zoning district under the zoning variance or deviations from dimensional requirements (e.g. setbacks or area coverage).
  • Use variance – Grant exceptions for proposed uses that are disallowed in a particular zoning district.

Some applications to either board may also require review by the Adirondack Park Agency (APA), certain NYS Departments (e.g. DEC, DOT, DOH) and⁄or the Fulton County Planning Board.
